1. The Role of Lusso Rinnato

Lusso Rinnato (“we”, “us”) operates an online marketplace that connects independent sellers of pre-owned luxury goods with buyers worldwide. Lusso Rinnato is not a party to any sale between Buyer and Seller, does not take title to Products at any point in time, and does not act as the seller, agent, broker, or representative of any User.

Each contract of sale is concluded directly between Buyer and Seller. Lusso Rinnato facilitates the listing, authentication review, payment processing, and shipping logistics of the transaction, but the underlying contract for the Product is between the two Users.

2. Acceptance of Terms

By accessing or using the Lusso Rinnato platform, you agree to be bound by these Terms of Service, our Privacy Policy, our Authenticity Policy, our Acceptable Use Policy, and — if you list Products — the Seller Agreement. If you do not agree, you may not use the platform.

We may modify these Terms at any time. Material changes will be announced on the platform. Your continued use after the effective date of any change constitutes acceptance.

3. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You must have full legal capacity to enter into binding contracts.
• You must not be barred from using the platform under applicable export, sanctions, or other laws.
• Sellers are admitted by invitation only and remain subject to ongoing review.

4. Authentication — Professional Opinion, Not Certificate

Every Product offered on the platform is reviewed by our in-house authentication team at our authentication hub before shipping. Our review combines physical inspection, photographic comparison against reference items, hardware and stamp verification, and documentary checks.

Authentication conclusions issued by Lusso Rinnato represent the considered professional opinion of our experts. They do not constitute a certificate of authenticity, proof of authenticity, or similar instrument, are not based on data from brands or manufacturers, and may not be presented to third parties as such. Brands and manufacturers may not honour any conclusion of authenticity reached by Lusso Rinnato.

5. Listings, Descriptions and Pricing

• Sellers are solely responsible for the accuracy of every listing, including authenticity, description, condition, photographs and provenance.
• Condition grades reflect our reasonable visual assessment and are inherently subjective.
• Colour, texture and tone may vary across screens and lighting; we make no warranty as to perfect colour reproduction.
• Prices may be displayed in multiple currencies and are subject to change without notice prior to checkout.
• We may decline, suspend or remove any listing at our sole discretion.

6. Orders, Payment and Escrow

• Payments are processed by Stripe. Your use of payment services is also subject to Stripe’s terms.
• Funds are held in escrow until the Buyer’s acceptance window (see Section 8) expires or the Buyer confirms acceptance.
• All taxes, duties and import fees are the Buyer’s responsibility unless stated otherwise.
• We may cancel any order, including after payment, for suspected fraud, pricing errors, sanctions screening, authentication failure, or Seller breach. In that event the Buyer receives a full refund of the Product price.

7. Shipping

Shipping timelines and carriers are described on our Shipping & Returns page. Lusso Rinnato is not liable for carrier delays, customs delays, or events of force majeure. Insurance claims are processed in accordance with the carrier’s rules.

8. Buyer Protection

Subject to the conditions set out in our Buyer Protection page, the Buyer may open a case within 7 days of delivery if a Product is materially not as described or fails our post-delivery authenticity review. Approved cases result in a full refund of the Product price upon return of the Product in the condition received.

Buyer Protection is a discretionary commercial policy offered by Lusso Rinnato and does not modify the contractual relationship between Buyer and Seller or expand Lusso Rinnato’s liability beyond Section 11 below.

9. Seller Obligations and Indemnification

If you list a Product, you separately agree to the full Seller Agreement. Among other obligations, Sellers represent and warrant that every listed Product is authentic, legally acquired, owned free of liens, and accurately described.

Sellers agree to indemnify, defend, and hold harmless Lusso Rinnato, its officers, employees, agents and affiliates from any and all claims, damages, losses, liabilities and expenses (including reasonable attorneys’ fees) arising from a Product later determined to be counterfeit, misdescribed, stolen, infringing, or otherwise non-conforming, including any refunds paid by Lusso Rinnato to Buyers.

10. Disclaimer of Warranties

The platform and all products listed are provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, Lusso Rinnato expressly disclaims all warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, title, quiet enjoyment, and any warranties arising out of course of dealing or usage of trade.

Without limiting the foregoing, Lusso Rinnato does not warrant that listings are error-free, that the platform will be uninterrupted, or that any Product’s market or investment value will be preserved or appreciated.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Lusso Rinnato’s total aggregate liability to any User arising out of or related to the platform or any Product shall not exceed the amount actually paid by the Buyer for the Product giving rise to the claim.

In no event shall Lusso Rinnato be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, including loss of profits, revenue, data, goodwill or other intangible losses, even if Lusso Rinnato has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this Section may not apply to you. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.

12. Indemnification by Users

You agree to indemnify, defend, and hold harmless Lusso Rinnato and its affiliates from any claim, demand, loss, liability or expense (including reasonable attorneys’ fees) arising from (a) your use of the platform; (b) your breach of these Terms or any incorporated policy; (c) your violation of any law or the rights of a third party; or (d) any content you submit to the platform.

13. Prohibited Activities

You must not use the platform to:

• List, sell or attempt to sell counterfeit, stolen, illegally imported, or otherwise infringing Products.
• Submit false or misleading information, photographs or descriptions.
• Circumvent or attempt to circumvent the authentication review.
• Use automated systems (bots, scrapers, crawlers) to access the platform without our express written consent.
• Reverse engineer or copy our processes, software or branded materials.
• File chargebacks or payment disputes in bad faith.
• Engage in any conduct prohibited by our Acceptable Use Policy.

Counterfeit listings will be removed, the Seller’s account may be terminated, and the matter may be reported to brand protection programmes and law enforcement.

14. Intellectual Property

• All platform content, trademarks, layouts, and code are owned by Lusso Rinnato or its licensors.
• Photographs of Products taken by our team are licensed for use on the platform only.
• Brand names and trademarks belong to their respective owners; their appearance on the platform does not imply endorsement or partnership.
• Brand owners may submit infringement notices through our IP / DMCA process.

15. Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Binding Arbitration & Class-Action Waiver

Any dispute, claim or controversy arising out of or relating to these Terms or the platform shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association Commercial Arbitration Rules, seated in Wilmington, Delaware, USA, conducted in English. Judgment on the award may be entered in any court of competent jurisdiction.

You and Lusso Rinnato agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective or representative action. Jury trials are waived.

Nothing in this Section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

17. Termination

We may suspend or terminate your access to the platform at any time, with or without notice, for any reason including breach of these Terms. Sections that by their nature should survive termination (including Sections 9, 10, 11, 12, 15, 16) will survive.

18. Severability and Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with the policies referenced above, constitute the entire agreement between you and Lusso Rinnato regarding the platform.
