1. Acceptance of Terms
By accessing or using Lusso Rinnato's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. We reserve the right to modify these terms at any time, and your continued use constitutes acceptance of any changes.
2. Seller Eligibility and Selection
Lusso Rinnato operates a curated marketplace with strict seller standards:
- Only selected, experienced sellers may list items on our platform
- Seller applications are subject to review and approval at our sole discretion
- We reserve the right to refuse, suspend, or terminate any seller account without notice
- Approved sellers must maintain quality standards and comply with all authentication requirements
- Seller privileges may be revoked at any time for any reason
3. Product Listings and Authenticity
3.1 Authentication Process
- All items undergo multi-point authentication by certified experts
- We reserve the right to reject any item that fails authentication
- Authentication decisions are final and at our sole discretion
- Items suspected of being counterfeit will not be returned and may be reported to authorities
3.2 Item Descriptions
- We strive for accurate descriptions but do not guarantee perfection
- Condition ratings are assessments based on industry standards
- Natural variations in luxury goods may not be explicitly noted
- Colors may vary due to photography and display settings
4. Pricing and Payments
- All prices are in USD unless otherwise stated and are subject to change without notice
- Payment processing is handled by Stripe; you must comply with Stripe's terms
- We are not responsible for payment processing errors or delays
- Prices do not include applicable taxes, duties, or customs fees (buyer's responsibility)
- We reserve the right to cancel orders due to pricing errors
5. Order Acceptance and Cancellation
5.1 Our Rights
- We reserve the right to refuse or cancel any order for any reason
- Reasons for cancellation may include: suspected fraud, pricing errors, item availability, or violation of terms
- If an order is cancelled after payment, we will issue a full refund
- We are not liable for any damages resulting from order cancellation
5.2 Buyer Cancellations
- Orders may be cancelled within 2 hours of purchase if item has not shipped
- Once shipped, standard return policy applies (see Shipping & Returns)
- No cancellations accepted after item has been shipped
6. Buyer Protection Program
Our Buyer Protection covers authenticity and item description accuracy, subject to:
- Claims must be filed within 7 days of delivery
- Item must be returned in the same condition as received
- Proof of issue must be provided (photos, expert opinion, etc.)
- Our authentication determination is final and binding
- Protection does not cover buyer's remorse or sizing issues
- Fraudulent claims may result in account termination and legal action
7. Trade Service Terms
7.1 Service Overview
- Lusso Rinnato acts solely as an intermediary platform facilitating peer-to-peer trades
- We are not a party to any transaction between buyers and sellers
- The Trade service is provided "as is" without warranties of any kind
- We reserve the right to refuse, cancel, or suspend any trade at our sole discretion
- Eligibility for Trade service may be revoked at any time without notice or explanation
7.2 Service Fees and Payment Processing
- A non-refundable service fee of $50 USD is charged to the seller for each trade
- This fee covers authentication, payment processing, insurance, and platform services
- The service fee is deducted before payment release to the seller
- Payment is held in escrow until successful delivery is confirmed by the buyer
- Payment may be held for up to 30 days after delivery for quality assurance purposes
- We reserve the right to adjust fees at any time; new fees apply to future trades
- Refunds of the service fee are not provided under any circumstances, including trade cancellation or authentication failure
7.3 Authentication and Inspection
- All items submitted for trade undergo mandatory authentication at our facility
- Authentication typically takes 4-5 business days but may take longer at our discretion
- No compensation is provided for authentication delays, regardless of duration
- Our authentication determination is final, binding, and non-appealable
- We are not required to provide detailed explanations for authentication decisions
- Authentication criteria and methodologies are proprietary and confidential
- Items are inspected for authenticity, condition accuracy, and compliance with luxury goods standards
7.4 Failed Authentication and Counterfeit Items
- Items that fail authentication will be handled in accordance with applicable federal, state, and international regulations
- Lusso Rinnato is not obligated to return items that fail authentication
- Items determined to be counterfeit, fraudulent, or in violation of intellectual property laws may be confiscated, destroyed, or reported to relevant authorities without notice or compensation
- The buyer will receive a full refund of the purchase price if an item fails authentication
- The seller forfeits all rights to items that fail authentication
- Sellers who submit counterfeit items may face account termination, legal action, and criminal prosecution
- We reserve the right to cooperate with law enforcement and brand protection agencies
- Sellers agree to release Lusso Rinnato from any liability related to confiscated or destroyed items
7.5 Seller Responsibilities and Representations
- Sellers warrant that all items listed are authentic, legally acquired, and owned free and clear
- Sellers are solely responsible for accurate item descriptions, condition reports, and photographs
- Sellers must disclose all material defects, repairs, alterations, or imperfections
- False or misleading descriptions may result in trade cancellation and account termination
- Sellers are responsible for proper packaging and shipping items to our facility
- Lusso Rinnato is not liable for damage incurred during seller-to-facility shipping
- Sellers acknowledge that providing counterfeit goods is illegal and may result in civil and criminal penalties
7.6 Buyer Responsibilities
- Buyers must accept or reject items within 7 days of delivery
- Items must be returned in the same condition as received for disputes
- Buyers are responsible for customs, duties, and import taxes in their jurisdiction
- Buyer's remorse, size dissatisfaction, or preference changes are not valid grounds for return
- Disputes must be filed through our platform; external chargebacks may result in account termination
7.7 Cancellations and Modifications
- Sellers may cancel a trade before buyer acceptance without penalty
- Once the buyer pays, cancellation requires mutual agreement or our approval
- Lusso Rinnato may cancel any trade for any reason, including suspected fraud, policy violations, or operational concerns
- If we cancel a trade, the buyer receives a full refund; the seller receives no compensation for time or effort
- Service fees are retained by Lusso Rinnato even if the trade is cancelled for authentication failure
7.8 Disclaimers and Limitations
- Lusso Rinnato makes no guarantees regarding trade completion timelines
- We are not responsible for communication failures between buyers and sellers
- Disputes between buyers and sellers must be resolved between the parties; we may facilitate but are not obligated to do so
- We do not guarantee item market value, resale potential, or investment performance
- Shipping and handling times are estimates only and not guaranteed
- Our liability is limited to the service fee paid; we are not liable for item value or consequential damages
- Force majeure events (natural disasters, pandemics, government actions) release us from performance obligations
7.9 Indemnification for Trade Users
By using the Trade service, you specifically agree to indemnify, defend, and hold harmless Lusso Rinnato from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your submission of counterfeit, stolen, or fraudulently obtained items
- Disputes with other users regarding trade transactions
- Violations of intellectual property rights, brand protections, or trademark laws
- Breach of these Trade terms or any applicable laws and regulations
- Your misrepresentation of item authenticity, condition, or ownership
- Any action or inaction by Lusso Rinnato related to authentication, confiscation, or reporting of items
7.10 Acknowledgment and Acceptance
By creating a trade listing or accepting a trade invitation, you explicitly acknowledge that you have read, understood, and agree to be bound by all Trade Service Terms. You acknowledge that these terms heavily favor Lusso Rinnato's protection and that you voluntarily accept these terms to access our facilitation services.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Lusso Rinnato is not liable for any indirect, incidental, special, or consequential damages
- Our total liability for any claim shall not exceed the purchase price of the item in question
- We are not responsible for shipping carrier delays, loss, or damage (insurance claims apply)
- We do not guarantee item investment value, resale value, or appreciation
- Items are sold "as is" regarding wear consistent with age and stated condition
9. Intellectual Property
- All content, trademarks, and intellectual property belong to Lusso Rinnato or respective owners
- You may not reproduce, distribute, or create derivative works without written permission
- Product photos and descriptions are our property and may not be used elsewhere
- Brand names and trademarks are property of their respective owners
10. Prohibited Activities
Users are prohibited from:
- Providing false or misleading information
- Using the platform for fraudulent purposes
- Attempting to circumvent our authentication process
- Reselling items purchased from us as new or authentic without disclosure
- Using automated systems to access our services
- Reverse engineering or copying our business processes
- Filing chargebacks or payment disputes in bad faith
11. Dispute Resolution and Governing Law
11.1 Governing Law

11.2 Dispute Resolution
